Because North Carolina requires that spouses live separately before filing for divorce, North Carolina law recognizes two types of spousal support.

  • Post-Separation Support is financial support paid after the parties separate but before there is a final determination on alimony (or “permanent”) spousal support.
  • Alimony is paid after the divorce is finalized. It is based on whether the spouse requesting support has established the need for support (or is “dependent”), the reasonable needs of the dependent spouse, and whether the “supporting” spouse has the ability to pay.
